Terms for using ImageChanger's AI image generation services
Introduction
These Terms of Service ("Terms") govern your use of ImageChanger, including our website, AI image generation tools, uploaded reference images, generated outputs, account features, credits, subscriptions, downloads, and support (collectively, the "Service"). By accessing or using the Service, you agree to these Terms.
Eligibility and Accounts
You must be legally able to enter into this agreement in your jurisdiction. If you use the Service for an organization, you confirm that you have authority to bind that organization.
Some features are available without creating a full account; others require an account. Keep your sign-in credentials confidential and promptly notify us of suspected unauthorized use. You are responsible for activity carried out through your account or guest session.
Using the Service
ImageChanger provides AI-assisted image generation and editing tools. You are responsible for your prompts, instructions, uploads, and use of the generated output. You must comply with applicable law, these Terms, and any rules that apply to the underlying AI providers.
Do not interfere with the Service, attempt unauthorized access, automate use beyond our published limits, submit malware, or use the Service to violate another person's rights. Our Acceptable Use and Content Standards below are part of these Terms.
Acceptable Use and Content Standards
You must not create, upload, request, distribute, or make available any content through the Service that falls into the following categories:
- Sexual or NSFW content: pornography, explicit sexual activity, sexual nudity intended for arousal, or any non-consensual intimate imagery.
- Violence or gore: graphic, gratuitous, or glorified depictions of violence, serious injury, cruelty, or gore; or content that credibly promotes or instructs violence.
- Hate speech: content that attacks, demeans, dehumanizes, threatens, or promotes discrimination or violence against a person or group based on a protected characteristic.
- Child sexual abuse material (CSAM) or child exploitation: any sexualized depiction of, sexual content involving, or material that exploits, endangers, or facilitates harm to a minor. This is strictly prohibited.
- Deceptive deepfakes or impersonation: realistic or deceptive content that falsely represents a person, organization, event, or source; uses a person's likeness without the required permission; or is intended to mislead, defraud, harass, defame, or harm. This includes non-consensual deepfakes and identity impersonation.
- Intellectual-property infringement: content that infringes or misappropriates another person's copyright, trademark, publicity, privacy, or other proprietary rights. Do not submit or generate third-party material unless you have all required rights, permissions, and legal basis.
You must also not use the Service for unlawful, fraudulent, exploitative, abusive, defamatory, privacy-invasive, or harmful activity; to evade safety controls; or to violate applicable law or another person's rights. You remain responsible for reviewing Your Content and outputs before using or sharing them.
Content Reporting, Moderation, and Enforcement
To report suspected prohibited content or misuse, email support@imagechanger.net or use our contact page. Include a link, relevant account or generation details, and a brief description of the concern. Do not include illegal content, including suspected CSAM, as an attachment; report it to the appropriate authorities where required by law.
We use layered safeguards to enforce these standards. Depending on the feature and providers involved, these may include automated checks, safety controls operated by AI model providers, and human review of reports or suspected misuse where appropriate. Review may occur before, during, or after generation. These measures cannot identify every violation and do not transfer responsibility for content to us.
We may investigate suspected violations and, where reasonably necessary, reject or stop a generation, remove or restrict access to content, limit features, suspend or terminate an account, preserve relevant information, or cooperate with lawful requests from authorities. We may take these actions without prior notice when needed to protect users, providers, the public, or the Service.
Your Content and AI Outputs
"Your Content" includes prompts, instructions, and images or other materials you upload. You represent that you have the rights, permissions, and lawful basis needed to submit Your Content and to use the resulting outputs.
As between you and ImageChanger, you retain the rights you may have in Your Content and generated outputs, subject to applicable law and third-party rights. AI outputs may not be unique, may be inaccurate, and may resemble content created for other users. We do not guarantee that any output is copyrightable, available for exclusive use, non-infringing, or fit for a particular purpose.
You grant ImageChanger and its service providers a limited, non-exclusive right to host, process, transmit, store, and display Your Content and outputs only as needed to operate, secure, support, troubleshoot, and improve the Service. Do not upload personal data, confidential information, or third-party material unless you are authorized to do so.
Intellectual Property
The Service, including its software, design, trademarks, branding, and original materials, is owned by ImageChanger or its licensors and is protected by applicable intellectual-property laws. These Terms do not grant you a right to copy, sell, lease, reverse engineer, or otherwise misuse the Service or its underlying technology.
Credits, Subscriptions, and Billing
Paid features may use credits, subscriptions, or plan limits. The price, currency, credits, renewal terms, and included features shown at checkout and on the pricing page form part of your purchase. Subscription charges renew automatically at the stated interval unless you cancel before renewal.
You can manage or cancel an active subscription through the billing portal when it is available. Cancellation takes effect at the end of the current paid period unless checkout states otherwise. Moving to a higher plan starts a new checkout immediately; after successful payment, the new plan's credits are granted and the previous plan is canceled. Moving to a lower plan, or changing billing periods, stops renewal on the current plan. It remains active until the paid period ends, and you must choose and pay for the new plan after that date. We do not create an automatic charge for that new subscription. Credits are consumed according to the selected model and generation settings, and may expire as stated when granted.
Payments are processed by our payment provider, currently Waffo Pancake when payment is enabled. We do not receive or store your complete payment-card details. Taxes, if applicable, are handled as described during checkout by the payment provider.
Refunds
Digital services and credits are generally non-refundable once delivered. A first purchase may be considered for a full refund within 24 hours only when none of the related subscription credits have been used. Duplicate or incorrect charges, verified severe platform errors, legal requirements, and payment-provider constraints are reviewed case by case.
Renewals, upgrades, repeated purchases, dissatisfaction, unused subscription time, and unused credits are otherwise not refundable. No prorated refund is provided when you cancel a subscription. To request a review, email support@imagechanger.net from the account email address with your purchase details. Approved cash refunds are processed manually through Waffo Pancake.
Third-Party Services and Availability
The Service relies on hosting, storage, authentication, payment, customer-support, security, and AI model providers. Their availability, policies, model behavior, and technical limits may affect the Service. We may change, add, or discontinue models and features without guaranteeing continued access to any particular model, output, speed, or result.
The Service is provided "as is" and "as available" to the maximum extent permitted by law. We do not warrant uninterrupted, secure, error-free, or loss-free operation.
Disclaimer and Limitation of Liability
To the fullest extent permitted by law, ImageChanger is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunity arising from the Service, AI outputs, third-party providers, or service interruptions.
Nothing in these Terms excludes liability that cannot legally be excluded. Where liability cannot be excluded but may be limited, our aggregate liability for claims related to the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim.
Indemnity
To the extent permitted by law, you will defend and indemnify ImageChanger and its operators, affiliates, and service providers against claims, losses, liabilities, and reasonable expenses arising from Your Content, your generated outputs, your use of the Service, or your breach of these Terms or another person's rights.
Changes and Contact
We may update these Terms as the Service evolves. Material changes take effect when posted on this page with a revised date, unless a different effective date is stated. Your continued use after the effective date means you accept the updated Terms.
